- Substantive response: Within 45 days of receipt
- Extension: We may extend by an additional 45 days with notice if reasonably necessary
- Opt-Out requests: Honored within 15 business days
7. Non-Discrimination
EnrollSmartNow, LLC will not discriminate against you for exercising any of your CCPA/CPRA rights. We will not:
- Deny you access to our services
- Charge different prices or rates
- Provide a different level or quality of service
- Suggest that you will receive a different price, rate, or level of service
because you exercised any right under this Notice or the CCPA/CPRA.
8. Sensitive Personal Information
Under the CPRA, certain categories of information are classified as "sensitive personal information" which carries additional protections. We collect the following sensitive personal information:
- Health Information: General health status answers and tobacco/nicotine use, collected solely to match you with appropriate insurance coverage and shared only with licensed insurance agents for that purpose
You have the right to limit our use of this sensitive information to only what is necessary to provide the insurance comparison service you requested.
9. Data Retention
We retain personal information for the following periods:
- TCPA consent records: Minimum 5 years (FCC regulatory requirement)
- Contact and lead information: Up to 3 years from last interaction
- Website analytics data: Up to 24 months
- Opt-out/DNC records: Indefinitely (to prevent re-contact)
After applicable retention periods, information is securely deleted or anonymized.
