1. Parties & Acceptance

These Terms and Conditions ("Terms") govern your access to and use of the websites located at enrollsmartnow.com and fe.enrollsmartnow.com (collectively, the "Sites"), and any related services provided by EnrollSmartNow, LLC, a North Carolina limited liability company ("Company," "we," "us," or "our").

By accessing the Sites, submitting any form, calling our telephone number, or otherwise interacting with our services, you agree that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must immediately cease use of the Sites.

2. Nature of Our Services

EnrollSmartNow, LLC is an insurance marketing organization (IMO) and lead generation service. We are NOT any of the following:

• An insurance carrier or underwriter
• A claims administrator
• An insurance agent (we connect you with licensed agents — we are not the agent ourselves)
• A government agency, or affiliated with Medicare, Medicaid, or the Social Security Administration

Our service consists of connecting consumers who are seeking final expense and life insurance information with state-licensed, independently appointed insurance agents and carriers ("Marketing Partners") who are listed on our Marketing Partners page.

We are compensated by insurance carriers and agents when a policy is issued — not by you. Our comparison service is free to consumers.

3. Eligibility Requirements

To use our Sites and services, you must:

• Be at least 18 years of age
• Be a resident of the United States
• Be the subscriber or authorized user of any phone number you provide
• Provide accurate and truthful information on any form you submit
• Agree to and comply with these Terms

By using our Sites, you represent and warrant that you meet all eligibility requirements. Providing false information on our forms may result in voided insurance applications and may constitute fraud under applicable law.

4. Consent to Contact (TCPA)

By submitting any form on our Sites and checking the required TCPA consent checkbox, you provide your prior express written consent under the Telephone Consumer Protection Act (47 U.S.C. § 227) for EnrollSmartNow, LLC and each of the licensed insurance agents and companies individually listed on our Marketing Partners page to contact you at the telephone number you provided, using live agents, automated telephone dialing systems, prerecorded voice messages, or SMS/text messages — even if your number is on a state or federal Do Not Call list.

You also separately acknowledge that:

• Your consent to be contacted is NOT a condition of purchasing insurance or any product
• You may revoke consent at any time by emailing [email protected], calling (913) 942-0957, or replying STOP to any text message
• Standard message and data rates may apply to text messages
• A TCPA LeadID may be assigned to your submission for compliance documentation purposes

For AI-generated voice message consent and email consent, refer to the separate consent checkboxes on our form. AI voice consent is optional and separate from standard telephone consent, in compliance with the FCC's February 2024 AI voice call rule.

5. Not Insurance Advice

All content on our Sites is provided for informational purposes only and does NOT constitute professional insurance, financial, legal, or medical advice. Sample premium rates, coverage illustrations, and product descriptions shown on our Sites are illustrative examples only — not quotes, offers, or guarantees of any particular premium or coverage.

You should consult with a licensed insurance professional in your state before making any insurance purchasing decisions. The licensed agents you speak with through our service are independent contractors — not employees of EnrollSmartNow, LLC.

6. No Guarantee of Coverage or Eligibility

Submitting a form on our Sites does not:

• Create an insurance contract or policy
• Guarantee that you will qualify for any insurance coverage
• Guarantee any particular premium, coverage amount, or plan
• Constitute an application for insurance

All insurance coverage is subject to underwriting review, health qualification questions, carrier approval, and applicable state law. Not all applicants will qualify for coverage.

7. Acceptable Use / User Conduct

You agree to use our Sites only for lawful purposes and in compliance with all applicable federal, state, and local laws. You agree not to:

• Provide false, misleading, or fraudulent information on any form
• Submit forms on behalf of another person without their express authorization
• Use automated systems, bots, crawlers, or scrapers on our Sites without our written consent
• Attempt to gain unauthorized access to any portion of our Sites or systems
• Engage in any activity that disrupts or interferes with our Sites or servers
• Use our Sites in any manner that could damage our reputation or the interests of our users
• Collect personal information of other users from our Sites

8. Intellectual Property

All content on our Sites — including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software — is the property of EnrollSmartNow, LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our Sites for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content from our Sites without our express prior written permission.

9. Privacy Policy

Your use of our Sites is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Sites, you consent to the collection, use, and sharing of your personal information as described in the Privacy Policy.

10. Disclaimer of Warranties

OUR SITES AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

EnrollSmartNow, LLC does not warrant that:

• The Sites will be uninterrupted, timely, secure, or error-free
• Any content on the Sites is accurate, complete, reliable, current, or error-free
• Any defects in the Sites will be corrected
• The Sites or servers are free of viruses or other harmful components

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ENROLLSMARTNOW, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, OUR SITES OR SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SITES EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT NOT PERMITTED BY LAW.

12. Indemnification

You agree to defend, indemnify, and hold harmless EnrollSmartNow, LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Any false or fraudulent information you provided
• Your use of the Sites in any manner not authorized by these Terms
• Your violation of any applicable law or the rights of a third party

13. Dispute Resolution & Binding Arbitration

A. Informal Resolution First

Before initiating any formal dispute proceeding, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

B. Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms, our Sites, or our services — including the scope and enforceability of this arbitration provision — shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules, except as modified herein. The arbitration shall be conducted in Rowan County, North Carolina, or by telephonic/video proceedings if agreed.

C. Class Action Waiver

YOU AND ENROLLSMARTNOW, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF REPRESENTATIVE OR CLASS PROCEEDING.

D. Exceptions

Either party may seek emergency or preliminary injunctive or other equitable relief from a court of competent jurisdiction as necessary to prevent irreparable harm. Claims of $10,000 or less may be brought in small claims court.

E. TCPA Claims

Nothing in this arbitration agreement limits your right to bring TCPA claims individually before the FCC or applicable state Public Utility Commission.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. For any matters not subject to arbitration under Section 13, you consent to exclusive jurisdiction and venue in the state and federal courts located in Rowan County, North Carolina.

15. Third-Party Links

Our Sites may contain links to third-party websites, including insurance carrier sites, agent sites, and regulatory resources. These links are provided for informational purposes only. We have no control over the content, privacy practices, or terms of third-party sites and are not responsible for their practices. Visiting third-party links is at your own risk.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days advance notice by:

• Posting a notice on our homepage
• Updating the "Last Revised" date at the top of this page
• Emailing users who have provided their email address (for significant changes)

Your continued use of our Sites after the notice period constitutes acceptance of the modified Terms. If you do not agree to any modification, you must stop using our Sites.

17. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of these Terms will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Sites, constitute the entire agreement between you and EnrollSmartNow, LLC with respect to your use of the Sites and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

19. Contact Information
