How we capture, store, and protect consumer consent to ensure full legal defensibility under TCPA, FCC, FTC, TSR, CMS, and state telemarketing laws.
EnrollSmartNow, LLC is an independent marketing company. We generate consumer inquiries through our websites and refer those inquiries to licensed insurance agents, agencies, and carriers ("Buyers"). We supply Buyers with leads (consumer contact information + consent records) and live transfer calls. We are compensated by Buyers for these referrals.
We do not: sell insurance, provide insurance quotes, enroll consumers in plans, or act as a licensed insurance agent or broker in any capacity.
Every consumer inquiry generated on our websites is subject to our four-layer consent verification system:
Every form requires the consumer to affirmatively check a consent checkbox before submitting. The checkbox is never pre-checked. The consumer must read and actively agree to the disclosure text which clearly identifies who will contact them and by what means (phone, text, email).
Every form load generates a unique Jornaya LeadiD token (GUID). This token records the entire lead event including consumer actions, the TCPA disclosure text displayed, timestamps, and URL history. A new, unique token is generated on every page load — it cannot be reused.
TrustedForm independently records a certificate of the lead event including a visual snapshot of the web page as the consumer saw it, consumer interactions, and the full consent disclosure. The TrustedForm certificate URL is stored with every lead record.
Our system captures and permanently stores: the full HTML of the consent section, the consent text verbatim, the IP address, timestamp, user agent, page URL, referrer URL, and complete consumer action history.

Jornaya Visual Playback: By using our website and submitting a form, you acknowledge that Jornaya may provide Visual Playback of your lead event to our mutual clients who audit LeadiD tokens, upon written request. Visual Playback provides a virtual rendering of the actual event data captured at the time of the lead event, including the consent disclosure that was displayed and consumer actions during the event. Every company that purchases leads or calls from EnrollSmartNow must execute a written agreement containing, at minimum, the following protections:
Buyer agrees to indemnify, defend, and hold harmless EnrollSmartNow, its officers, directors, and employees from any claims, damages, fines, or penalties arising from Buyer's use of leads or calls, including any TCPA violations resulting from Buyer's calling practices.
Buyer may not resell, sublicense, or transfer consumer data to any third party without prior written consent from EnrollSmartNow and the consumer. Consent documentation must accompany any permitted transfer.
Consumer data may only be used for the specific insurance vertical for which consent was obtained. Medicare leads may not be used for ACA outreach, etc. Out-of-scope use is prohibited and constitutes material breach.
EnrollSmartNow provides full consent documentation (Jornaya LeadiD, TrustedForm URL, IP, timestamp, consent text) with every lead. Buyer must retain this documentation for a minimum of 5 years.
